Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, products, and services (collectively, the "Services") provided by So Delighted LLC, a limited liability company organized in New Hampshire, United States ("So Delighted," "we," "us," or "our"), including the Superfluous AI application-hosting platform at superfluous.ai. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the activity under your account and for keeping your credentials secure. Notify us promptly at [email protected] of any unauthorized use.

2. The Services

The Services let you deploy, host, and operate web applications and related content. We may add, change, or remove features over time. We may also set technical limits (for example, on compute, storage, bandwidth, or request volume) and may vary those limits by plan.

3. Acceptable use

You agree not to use the Services to:

• violate any law or the rights of others;
• distribute malware, run phishing, or attempt to gain unauthorized access to any system;
• send unsolicited bulk messages (spam) or engage in fraud;
• host content that is illegal, or that infringes intellectual-property or privacy rights;
• disrupt, overload, or circumvent the security or integrity of the Services or other users' workloads.

We may suspend or remove content or accounts that we reasonably believe violate these Terms, with or without notice where the law or an urgent security or abuse concern requires it.

4. Your content

You retain all rights to the applications, code, and data you host through the Services ("Your Content"). You grant us a limited license to store, process, transmit, and display Your Content solely as needed to operate and provide the Services to you. You are responsible for Your Content and for having the rights necessary to use it.

5. Fees & payment

Paid plans and their prices are described at the point of purchase. Fees are billed in advance on a recurring basis unless stated otherwise, are charged to your designated payment method, and are stated in U.S. dollars. Payments are processed by our third-party payment processor; by purchasing, you also agree to that processor's terms. Cancellations and refunds are governed by our Refund & Cancellation Policy.

6. Third-party services

The Services may integrate with or depend on third-party providers (for example, cloud infrastructure, payment processing, and email delivery). We are not responsible for third-party services, and your use of them may be subject to their own terms.

7. Intellectual property

The Services, including our software, branding, and documentation (but excluding Your Content), are owned by So Delighted or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SO DELIGHTED WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

10. Termination

You may stop using the Services and cancel any paid plan at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Services. On termination, your right to use the Services ends; sections that by their nature should survive (including fees owed, disclaimers, and limitations of liability) will survive.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, take reasonable steps to notify you. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of New Hampshire, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute will be the state or federal courts located in New Hampshire, and you consent to their jurisdiction.
